Terms of Sale, Exchange and Returns

1. General Provisions (Terms of Sale)

1.1. Purpose

These terms govern the contractual relationship between Áeo (the “Seller”) and the customer (the “Buyer”) on the online store. By placing an order, the Buyer fully accepts these terms.

1.2. Prices

Prices are shown in euros (€) and include the applicable VAT within the European Union, unless otherwise stated. Shipping costs are displayed separately before checkout.

1.3. Order and Payment

The contract is considered concluded once Áeo sends the order confirmation to the Buyer.

Áeo reserves the right to refuse orders in cases of suspected fraud or product unavailability.

1.4. Shipping and Delivery

• Delivery times: Estimated delivery times are provided before purchase.

• Transfer of risk: Responsibility for the goods transfers to the Buyer upon physical receipt of the parcel (or to a third party designated by the Buyer).

2. Right of Withdrawal (Standard Returns)

(In compliance with the European Consumer Rights Directive)

2.1. Withdrawal Period

The Buyer may withdraw from the contract without giving any reason within fourteen (14) calendar days from the date of receiving the product.

2.2. How to Exercise the Right of Withdrawal

The Buyer must notify Áeo of their decision to withdraw via a clear statement (email or online form) within the prescribed period.

2.3. Conditions of Returned Goods

Returned items must:

• Be in their original condition, complete and unworn.

• Include the presentation box, tags and Certificate of Authenticity.

• Show no damage beyond what is necessary to verify their nature, characteristics and functioning.

Hygiene Exclusion – Earrings

Under Article 16(e) of the EU Consumer Rights Directive: Earrings are excluded from the right of withdrawal if the hygiene seal has been opened or tampered with.

To return earrings, the hygiene seal must remain intact.

2.4. Refunds

Áeo will refund all payments received, including standard delivery costs, within 14 calendar days of receiving the withdrawal notice.

Conditions:

• Refunds will be issued using the same payment method used for the original transaction.

• Áeo may withhold the refund until the goods have been received, or until proof of return is provided.

• Return shipping costs are the Buyer’s responsibility.

3. Exchanges (Size or Product)

3.1. Exchange Period

Exchanges may be requested within fourteen (14) calendar days of receiving the item, subject to stock availability.

3.2. Conditions and Costs

• Items must meet the same conditions as standard returns (unused, original packaging, complete).

• The Buyer is responsible for the cost of returning the original item.

• Áeo may choose to cover the cost of sending the replacement item, but this will be clearly communicated if applicable.

4. Legal Guarantee and Faulty Goods

(In compliance with Directive (EU) 2019/771)

4.1. Legal Guarantee

Áeo products are covered by a three-year legal guarantee of conformity from the date of delivery.

4.2. Faulty or Non-Conforming Goods

A product is considered faulty or non-conforming if it:

• Is not suitable for its normal intended use.

• Does not have the quality expected of goods of the same type.

• Does not match the description or characteristics presented by Áeo.

4.3. Buyer’s Rights

The Buyer is entitled to:

• Free repair, or

• Free replacement.

If these solutions are impossible or disproportionate, the Buyer may request:

• A price reduction, or

• Cancellation of the contract (return and refund).

Faults within the first year: Any defect appearing within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise.

5. Exclusions – Customised Products

5.1. Items Not Eligible for Withdrawal

Under Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to:

• Goods made to the Buyer’s specifications.

• Customised or personalised items (engraving, specific sizing, modifications).

Once customisation has begun, the item cannot be returned or exchanged, unless it has a manufacturing defect or does not match the agreed specifications.
